African Americans from 1865 Essay

African Americans have fought a great battle to become a part of society in America. Since being taken from African as slaves in the 1600’s there has been a continuous battle for equality since. Since the end of slavery Black Americans have had many accomplishments along with hardships. In this paper I will discuss some of the Major events in African American history beginning with the end of slavery which has lead to the America we know today. In 1865 Congress passed the thirteenth Amendment stating† Neither slavery nor involuntary servitude, except as a punishment for crime whereof the party shall have been duly convicted, shall exist within the United States, or any place subject to their jurisdiction† this was the outlawing of slavery and resulted in the established the Freedmen’s Bureau to assist former slaves. President Lincoln and other Republicans were concerned that the Emancipation Proclamation, which in 1863 declared the freedom of slaves in ten Confederate states then in rebellion, would be seen as a temporary war measure, since it was based solely on Lincoln’s war powers. The Proclamation did not free any slaves in the border states nor did it abolish slavery.[1] Because of this, Lincoln and other supporters believed that an amendment to the Constitution was needed. In many parts of the South, the newly freed slaves labored under conditions similar to those existing before the war. The Union army could offer only limited protection to the ex-slaves, and Lincoln’s successor, Andrew Johnson of Tennessee, clearly had no interest in ensuring the freedom of southern blacks. The new president’s appointments as governors of southern states formed conservative, proslavery governments. The new state legislatures passed laws designed to keep blacks in poverty and in posit ions of servitude. Under these so-called black codes, ex-slaves who had no steady employment could be arrested and ordered to pay stiff fines. Prisoners who could not pay the sum were hired out as virtual slaves. In some areas, black children could be forced to serve as apprentices in local industries. Blacks were also prevented from buying land and were denied fair wages for their work. This became the beginning of the Reconstruction. The Freedmen’s Bureau was designed to help former slaves make the transition from slavery to freedom after the civil war. It was a federal agency mostly involving blacks of the old confederacy ( Lowe, 1993). The Freedmen’s Bureau Bill, which created the Freedmen’s Bureau in March 1865, was initiated by President Abraham Lincoln and was intended to last for one year after the end of the Civil War.[2] The Freedmen’s Bureau was an important agency of the early Reconstruction, assisting freedmen (freed ex-slaves) in the South. The Bureau was part of the United States Department of War. Headed by Union Army General Oliver O. Howard, a Civil War hero sympathetic to black s.the Bureau was operational from 1865 to 1872. It was disbanded under President Ulysses S. Grant. Their responsibilities included introducing a system of free labor, overseeing some 3,000 schools for freedpersons, settling disputes and enforcing contracts between the usually white landowners and their black labor force, and securing justice for blacks in state courts. The Bureau was renewed by a Congressional bill in 1866 but was vetoed by President Andrew Johnson, who thought it was unconstitutional. Johnson was opposed to having the federal government secure black rights. Congress passed the bill over his veto. Southern whites were basically opposed to blacks having any rights at all, and the Bureau lacked military force to back up its authority as the army had been quickly disbanded and most of the soldiers assigned to the Western Their responsibilities included introducing a system of free labor, overseeing some 3,000 schools for freedpersons, settling disputes and enforcing contracts between the usually white landowners and their black labor force, and securing justice for b lacks in state courts. There is much more African American has to overcome and many victories and defeat, In the process of fighting for equality in 1909 The National Association for the Advancement of Colored People is founded in New York by prominent black and white intellectuals and led by W.E.B. Du Bois. For the next half century, it would serve as the country’s most influential African-American civil rights organization. In 1910, its journal, The Crisis, was launched. Among its well known leaders were James Weldon Johnson, Ella Baker, Moorfield Storey, Walter White, Roy Wilkins, Benjamin Hooks, Myrlie Evers-Williams, Julian Bond, and Kwesi Mfume. Throughout the 1920s and 1930s, the association led the black civil rights struggle in fighting injustices such as the denial of voting rights, racial violence, discrimination in employment, and segregated public facilities. Dedicated to the goal of an integrated society, the national leadership has always been interracial, although the membership has remained predominantly African American. The Harlem Renaissance flourishes in the 1920s and 1930s. This literary, artistic, and intellectual movement fosters a new black cultural identity. After the American civil war, liberated African-Americans searched for a safe place to explore their new identities as free men and women, they found it in Harlem. Also known as the New Negro Movement was a literary, artistic, cultural, intellectual movement that began in Harlem, New York after World War I and ended around 1935 during the Great Depression. The movement raised significant issues affecting the lives of African Americans through various forms of literature, art, music, drama, painting, sculpture, movies, and protests. In 1939 the NAACP established as an independent legal arm for the civil rights movement the NAACP Legal Defense and Education Fund, which litigated to the Supreme Court Brown v. Board of Education of Topeka, the case that resulted in the high court’s landmark 1954 school-desegregation decision. The organization had also won a significant victory in 1946, with Morgan v. Virginia, which successfully barred segregation in interstate travel, setting the stage for the Freedom Rides of 1961. 1954 Brown v. Board of Education case: strikes down segregation as unconstitutional. Linda Brown, an eight-year-old African American girl, had been denied permission to attend an elementary school only five blocks from her home in Topeka, Kansas. School officials refused to register her at the nearby school, assigning her instead to a school for nonwhite students some 21 blocks from her home. Separate elementary schools for whites and nonwhites were maintained by the Board of Education in Topeka. Linda Brown’s parents filed a lawsuit to force the schools to admit her to the nearby, but segregated, school for white students. The Board of Education’s defense was that, because segregation in Topeka and elsewhere pervaded many other aspects of life, segregated schools simply prepared black children for the segregation they would face during adulthood. The board also argued that segregated schools were not neccessarily harmful to black children; great African Americans such as Frederick Douglass, Booker T. Washington, and George Washington Carver had overcome more than just segregated schools to achieve what they achieved. The request for an injunction put the court in a difficult decision. On the one hand, the judges agreed with the expert witnesses; in their decision, they wrote: Segregation of white and colored children in public schools has a detrimental effect upon the colored children†¦ A sense of inferiority affects the motivation of a child to learn. [8] On the other hand, the precedent of Plessy v. Ferguson allowed separate but equal school systems for blacks and whites, and no Supreme Court ruling had overturned Plessy yet. Because of the precedent of Plessy, the court felt â€Å"compelled† to rule in favor of the Board of Education. [9] The Supreme Court struck down the â€Å"separate but equal† doctrine of Plessy for public education, ruled in favor of the plaintiffs, and required the desegregation of schools across America. The Supreme Court’s Brown v. Board of Education decision did not abolish segregation in other public areas, such as restaurants and restrooms, nor did it require desegregation of public schools by a specific time. It did, however, declare the permissive or mandatory segregation that existed in 21 states unconstitutional. [13] It was a giant step towards complete desegregation of public schools. Even partial desegregation of these schools, however, was still very far away, as would soon become apparent. The next year 1955 A young black boy, Emmett Till, is brutally murdered for allegedly whistling at a white woman in Mississippi. Two white men charged with the crime are acquitted by an all-white jury. They later boast about committing the murder. The public outrage generated by the case helps spur the civil rights movement (Aug.). Fourteen-year-old Emmett Till was visiting relatives in Money, Mississippi on August 24, 1955 when he reportedly flirted with a white cashier at a grocery store. Four days later, two white men kidnapped till, beat him, and shot him in the head. The men were tried for murder, but an all-white, male jury acquitted them. Till’s murder and open casket funeral galvanized the emerging civil rights movement. Rosa Parks refuses to give up her seat at the front of the â€Å"colored section† of a bus to a white passenger (Dec.1). She was arrested and convicted of violating the laws of segregation, known as â€Å"Jim Crow laws.† Mrs. Parks appealed her conviction and thus formally challenged the legality of segregation. In response to her arrest Montgomery’s black community launch a successful year-long bus boycott. Montgomery’s buses are desegregated on Dec. 21, 1956. 1963Martin Luther King is arrested and jailed during anti-segregation protests in Birmingham, Ala. He writes â€Å"Letter from Birmingham Jail,† which advocated nonviolent disobedience. The March on Washington for Jobs and Freedom is attended by about 250,000 people, the largest demonstration ever seen in the nation’s capital. Martin Luther King delivers his famous â€Å"I Have a Dream† speech. The march builds momentum for civil rights legislation (Aug. 28). Despite Governor George Wallace physically blocking their way, Vivian Malone and James Hood register for classes at the University of Alabama. Four young black girls attending Sunday school are killed when a bomb explodes at the Sixteenth Street Baptist Church, a popular location for civil rights meetings. Riots erupt in Birmingham, leading to the deaths of two more black youths (Sept. 15). 1964 President Johnson signs the Civil Rights Act, the most sweeping civil rights legislation since Reconstruction. The Civil Rights Act of 1964 is the nation’s benchmark civil rights legislation, and it continues to resonate in America. The Civil Rights Act of 1964 prohibits discrimination on the basis of race, color, religion, sex or national origin. An act to enforce the constitutional right to vote, to confer jurisdiction upon the district courts of the United States of America to provide injunctive relief against discrimination in public accommodations, to authorize the Attorney General to institute suits to protect constitutional rights in public facilities and public education, to extend the Commission on Civil Rights, to prevent discrimination in federally assisted programs, to establish a Commission on Equal Employment Opportunity, and for other purposes. Passage of the Act ended the application of â€Å"Jim Crow† laws, which had been upheld by the Supreme Court in the 1896 case Plessy v. Ferguson, in which the Court held that racial segregation purported to be â€Å"separate but equal† was constitutional. The Civil Rights Act was eventually expanded by Congress to strengthen enforcement of these fundamental civil rights References Of Du Bois and Diaspora: The Challenge of African American Studies. INTRODUCTION With technology getting obsolete by the seconds, one wonders if there is any relevance to the future. Especially for the trendy hospitality industry, where the race is to compete in fulfilling guest expectations. These expectations are related to the product, its character and personality.Hotel and resort chains spend a tremendous amount of time and money in researching user-friendly technology to remain competitive. Hotels and resorts are going hi-tech in every area of guest experience. A quick review of the use of technology in hotels and resorts reveals an interesting conclusion. Hotels, which do not keep pace with technology, may lose their gues t base while at the same time, a traveler who does not keep himself updated with technology may feel out of place in hi-tech hotels. Most city hotels are well equipped with latest, state of the art technology. The future hotels might see hotel rooms with much more advanced technology. For example, hotels are now adopting biometrics technology. This technology uses voice, fingerprints or retina scan for personal identification, replacing the room key and combination safe in the rooms. One has to glare at the door to get it opened or, touch the biometric sensor to open the safe. Practically all good hotels have high definition television sets, but with the advent of 3D revolution, hotels will have to switch to new technology sooner than later. The same technology will also be useful for telephonic and video conferencing.Touch screen telephones, compressor free mini bars, in-room environment control, electronic do not disturb signs etc, have now become as part of granted features in the rooms. The introduction of Control4 is going to further revolutionize the hotel systems. Imagine walking to the door of the room, the system detects the person, turns on the lights, TV, sets temperature of the room, and awaits guest’s arrival at the door. The TV starts to play a welcome message or introduces the room features as they enter the room. The system also manages the wakeup call and do not disturb process.Future hotels are going to use room window glass as a TV screen. A switch will make the glass opaque and a projection system from the ceiling will start your favorite program on the screen with surround sound digital speakers. Today, hotels offer high-speed wireless broadband internet connectivity in the rooms with interface to the TV. Some hotels however, offer wireless internet in the entire hotel, in every nook and corner. One can use the laptop anywhere. Hotels also offer color-printing facilities from the laptop at a central printer in the Business Center.Roo m motion sensors detect motion and body temperature, and set the room parameters to suit your body needs. If no motion is detected beyond a specified period, it turns off the air-conditioning, lights and TV. Timer settings are crucial for success of this system. For those who need to relax their muscles, hotels offer an electric massage chair in the rooms. No need to go to the spa for time strapped guests needing a quick fix. For satisfying a demanding hi-tech traveler, the art is to anticipate needs and tailor the product with such elements that satisfies these needs and wants.A few years back an hotelier could not have imagined a guest carrying his virtual office in his laptop, or his music collection in his i-Pod or MP3. Well, today he does. Hotels are therefore providing connectivity of these gadgets to the TV and sound system. Hotels are also providing connectivity cable to connect digital camera to the TV. The guest can view the quality of pictures in the privacy of his room. The bathrooms in hi-tech hotels are a delight to the eye and experience. Most hotels have frost-free mirrors, Multiple Volt shaver sockets, temperature controlled Jacuzzi. Rain shower and aqua massage systems.Heated seats for water closet and bidet are provided for additional comforts. A small color TV at the foot of the Jacuzzi and extension of room telephone. What one would see in the future is that the mirror will double as a computer screen and one could watch mails while soaking in the bath tub, sounds interesting!. The biggest challenge for the hotelier is to keep pace with technology. Implement technology in a cost efficient manner and to know where to draw a line. While being Hi-Tech sounds good, the concept also has a feel good factor, one must understand what and how much should be adopted in a hotel.Going green is another popular trend now, and not just in hospitality. But now, more than ever, resorts are jumping on the green bandwagon in a variety of ways. Be it organic sheets, using solar power or offering climate-neutral rooms, resorts are increasingly moving towards offering earth-friendly amenities. This is just a glimpse of different shades of technology being used or about to debut in hotels and resorts across the globe. The ultimate quality of the experiences and degree of satisfaction of hundreds of guests and visitors depends upon judicious and right use of technology. The smallest glitch in the system is enough to ruin the experience. The art is to anticipate the needs of tomorrow and provide them today, leaving one to wonder what happens the day after. II. COMPANY PROFILE Company Name: Marawi Leisure Park, Inc. We noticed that the hotel lacks of an elevator which more needed particularly for disabled person as well as for the convenience of the employees in assisting guest’s luggage. The construction of elevator will be a big help for the business. Furthermore, this will benefit the hotel and resort not just in sustaining their goals but also to exceed the expectations of the guests. Security of Guests and EstablishmentsBasically, the primary goal of the hotel and resort is to sell rooms, to provide fun and enjoyment, and to gain more profit. Excursionists and tourists who visit the hotel and resort must be given 24/7 security and safety while staying in the resort premises. To provide the 24/7 security and safety it is advisable to give more attention to the people who come in and out of the establishment. This way the visitors will be worry free while staying in the place. As a conclusion, we recommend to the hotel and resort the need for further management empowerment and innovative facilities to achieve the goals and objectives of the company.VII. Market research of phone cases (Iphone) and evidencing demand for this Assignment

Market research of phone cases (Iphone) and evidencing demand for this product - Assignment Example For instance, Iphones have been strong and efficient in the services they offer. This has been profoundly instrumental because customers always prefer products that are strong, durable and most importantly efficient in offering its intended services. For years, Iphones have been outstanding in their market performance as the company’s innovativeness has been its great tool (Diamantopoulos 2004). Different models of iPhones have evolved systematically with the quality being improved successively. In order to shield off stiff competition in the market the apple company has benefitted from the creativity, innovation and enterprising nature of its business model. The improvement of iPhone products has been both significant and a challenge in as far as the business environment is concerned. Some of the successive products end up finding resistance and low market reception. This is part of the business challenges but the Company must ensure that it remains relevant in the market not allowing to be overtaken by fierce competitors by improving the new product (Sinha, 2013). Despite the initial success and high market demand of iPhones in the market, challenges have crippled in as well. In the most recent past iPhone 5C model experienced an unsuccessful entry into the market. The demand of the Smartphone was significantly low, which led loss of profits and affected the product and the company’s profile in the market. This led to the reduction of its daily production with almost 50% (Sinha, 2013). Most of the iPhone 5C manufacturers admitted receiving orders to cut down daily rate of the product production. For instance, Pegatron reported instructions to cut the manufacturing of iPhone 5C by almost 75%. This resulted in the production of 80, 000 units on weekly basis from 320,000 units initially (Sinha, 2013). In general, the production of iPhone 5C reduced hugely and the company suffered huge profit and financial losses. In fact, there were

Current event analysis - Essay Example ates that the state of Florida announced they are facing a $3 billion dollar deficit and as a result the mental health programs could be cut by as much as thirty to fifty percent by the Florida House and the Florida Senate. Jacque Henderson, director of Tri-County Human Services residential programs in Lakeland spoke about the potential cuts and said that almost every significant advance in the last thirty-years, including drug court, mental health court, and miscellaneous treatment services, are all at risk of being cut. The current House plan is to cut over $172 million, while the Senate has a proposal for $205 million in cuts. Expressing similar sentiments to Jacque Henderson, Partners in Crisis was also highly concerned about the potential of losing drug court and mental health court programs. The article states that the Peace River staff has already taken 5% pay cuts, and only through a large private donation were they able to remain a viable institution. While the article does mention research that states recent statistical analysis states that the programs that might be cut have demonstrated significant preventative value, it doesn’t elucidate on these findings. While mental health programs should be of the utmost concern and valued as highly as other medical programs, one would hope to see some fiscal responsibility and proof of

Introductory Computer Usage 1 - Essay Example The other fact of the matter is that people are rarely aware of the technological advancements and their security concerns. Although IEEE has launched WPA and then WPA2 as the new security protocols, people seldom use them. WPA2 has proved hardest to be cracked, still old algorithms are preferred over it. The table shows the percentage of the people (taken from survey by Deloitte, India) who use secure and insecure wireless medium. Besides, if the new technology gets implemented, it slows down system performance. International Research Practices Essay Example | Topics and Well Written Essays - 750 words

International Research Practices - Essay Example Considering budget, it would be more practical to just select a local firm that can be the company's partner who will be able to make the company's goal of expanding internationally possible. Finding the right partner, though, is an additional task to the company as it is not that easy to find the right partner to do business with. This paper tries to answer particular questions raised with regard to expanding business internationally and business research practices for the coffee brewing systems company, JavaJoy. Since it is too tasking to conduct the research as an employee of the company, a third-party company is contracted to conduct the research on potential international markets. As mentioned above, expanding business globally is a big decision to make and before making the decision, there is lots of work needed to be done. It is not easy to find a country that can be a potential market, more so, find a business partner to represent the company. Extensive research should be done in order to make a sound decision. The research to be conducted is not as simple as it sounds. The tasks can be daunting and time consuming for an inexperienced company. Thus, it is better to just designate the work to a third-party research firm to be the company's partner in making the right decision. With the nature of the tasks to be done, this research firm partner should be well-experienced when it comes to conducting international business researches. They should have a proven track record in terms of making businesses going international successful. The company can seek referrals from other companies who have worked with research firms. One other thing to consider is the services the research firm offers. It is best to have one specific point person who is in-charge of all the transactions of the company and who will be able to answer all queries by the company. It is also best if the research firm can provide different options and suggestions in order to come up with the right decision. The research firm should indeed act as a partner or an ally of the company in making its goals of going global come true. What would you expect of them The partner in conducting the research should be able to understand how the entire business works. It may not be able to determine the right type of market or find the right local company to work with if it does not fully understand the missions and visions of the company. The first thing that I would expect them to do is to take time in understanding and learning the processes of the company, JavaJoy, what types of market does it cater to and what are the goals of the company. They should be able to show an effort that they need to know these things. One other thing that I would be expecting of them is a regular progress report of their research findings as the company, being the customer, should be well informed all the time. They should also be able to provide the company with a detailed breakdown of all the expenses made in order to gather all the information and research data needed. Overall, I would say that these would all sum up to professionalism. The partner to conduct inte rnational market research should be professional enough in the services they render. How would you go in finding such a partner and what would your selection criteria be Before starting to look for the right partner, there should be

As a result, many children in these communities drop out of school after the second phase of education curriculum which is the primary school system, to carry on their family businesses. the Bahai community of Lesotho in southern Africa and the Maasai and Samburu communities in Eastern Africa are among the communities where children drop out of school and shift to pastoralism activities. In these communities, pastoralism is the basic act of survival as the communities believe tha t their forefathers survived as a result of pastoralism. ‘Andy Blevins was a student at Radford University who made a big decision big decision in life as a result of financial setbacks but end up regretting in future’(Leonhardt, 15). College dropout boom presents a case that explains the reasons why many college students tend to drop out of school without fully completing the degree or diploma course. Many students in college drop out of school due to the idea that they can as well survive without the college degree certificate. This is the perception that Andy Blevins had when he dropped out of school while pursuing his college degree. Many college students find it normal to drop out of school

Someone Will Always Suffer Because of Conflict Essay Example for Free

Someone Will Always Suffer Because of Conflict Essay Someone Will Always Suffer Because of Conflict: Expository Practice SAC Conflict is inevitable, and constantly present in life. Whether it’s obvious and right in front of your face or hidden beneath a pile of lies someone will always suffer because of it. Although that being said, without it- would we truly understand the importance of peace? There are some out there who believe that some of the greatest triumphs and acts of the human spirit were during times of great conflict such as wars and repression’s. But I believe that these events have caused the most horrific demonstrations of human nature in the act of killing the innocent. In Arthur Miller’s tale of Witch hunts conducted in Salem during the 16th century in â€Å"The Crucible† he uses it as an allegory to show that sometimes the people who suffer the most during conflict actually are the most innocent. The story relates to a 1950’s America as Senator Joseph McCarthy would Blacklist innocent people for being â€Å"communists† due to little to no evidence and the person having a few opposing traits to him like being Liberal, Chinese, or speaking out against him. The public were okay with this of course, seeing how there was that much fear being spread and rumours of Russian communists taking over the country forced people to do whatever they could to save their â€Å"freedom†-even if they had spoken out against McCarthy for what he was doing, they probably would have been blacklisted themselves. This suffering relates back to the innocent people in Salem who refused to confess that they were Witches and were therefore jailed and some executed. The people who remained as not charged of being a witch still refused to speak out as they would be charged and persecuted also. More than one person suffered when it came to these conflicts, and it is sad to see how regard less that these two events in history were close to 400 years apart- human kind hadn’t changed, but instead repeated itself. If you were to look at any event in history where conflict was present you would definitely see suffering. During the holocaust the sufferers weren’t just the allies or Axis who lost their lives fighting- there were also the 6 million Jewish men, woman and even children who were slayed down as if they were sheep and gassed for being nothing more than them- selves. This wasn’t just suffering this was cruelty and an inhuman part of another greater conflict at the time. Also the suffering wasn’t over when the war finished either. It was at this time  after the war when Joseph McCarthy was placed as Senator and another whole decade of innocent people’s suffering began. Also prior to WWII when the conflict seemed to be â€Å"resolved† after World War I the great depression hit and even more people suffered due to it. The USA basically went into repression where and Americans found it ridiculously difficult to find work and make an income. In all these events in the 20th Century alone there were so many innocent sufferers because of a conflict that was greater than them, how can it be that there can be conflict without suffering? In the ongoing conflict of terrorism, one event stands out from the rest when it comes to the media, purely because of the severity and how big the statement of the crime committed was. In total, almost 3000 innocent people were killed in the September 11 attacks when two planes hit the World Stock Exchange in New York. These people were simply in the wrong place at the wrong time and due to a greater conflict between their government and the terrorist group Al Qaeda they were the victims. There were many wars and other conflicts that spread from this event which have led to the deaths of thousands of other innocent people-the question shouldn’t be â€Å"Will someone always suffer because of conflict† it should be â€Å"When will we stop suffering because of conflict†. Ultimately, it is clear that someone will always suffer because of conflict. Whether the conflict’s a war, a fight with your best friend or even your favourite team losing the grand final someone will always suffer because of it. But this does not matter. Because of suffering people will always try to overcome conflict and one day this world can have as minimal, unnecessary conflict as possible and people can work together to live in peace with one another.

Morality and Obligation Essay Example for Free

Morality and Obligation Essay 1. Two preliminary steps taken, that may be necessary, before one can intuitively appreciate the rightness of an action are thinking fully about the consequences of an action. In other words, think before you act. Also give thought (consideration) to the persons involved in said action or your relation(ship) with the persons involved. 2. An action is considered morally good in addition to being right when it is the right thing to do, while also stemming from a good place. When the person or agent performs said act because it is right, from a feeling of obligation, a morally good act is also right. 3. According to Prichard, an action done from a sense of obligation, there is no purpose consisting either in the action itself or in anything which it will produce. A motive, being something that moves one to act, can be the sense of obligation, an action done from a sense of obligation can indeed have a motive. 4. Avirtuous act is done from a desire that is intrinsically good. A moral act may be done from obligation. There cant be an obligation to act virtuously, because we can only feel an obligation to act or do something. We cannot, however, feel an obligation to act from a certain desire 5. It is a mistake to expect moral philosophy to prove through argumentation that we ought to fulfill our obligations, because moral rightness cannot be demonstrated, only apprehended directly by an act of moral thinking. The sense of obligation is a result of a moral thought or thoughts. Moral philosophy can provide reflection on the immediacy of our knowledge of moral rightness and the intuitive recognition of the goodness of the virtues.

Common And Civil Law Legal Systems Law Essay

Common And Civil Law Legal Systems Law Essay In general, law is set of general rules, regulations and principles accepted in some community and to applicable only in its territory, which is written by legislative authority. There are a lot of functions of law in the society and business. Some of the roles of the law are to keep the peace, shaping the rules of conduct and moral standards, promoting social justice and individual freedom, facilitating planning and orderly change and also protecting the environment. Law has been developing through many centuries and always changing according to the communitys social life, traditions and moral principles. Nowadays there are as many legal systems as many number of countries in the world. However all countrys over the world developed and incorporated their own laws based on three main types of legal systems such as Civil law (Continental law), Common law and Religious (Islamic) law. All these three legal systems have their own features and histories which helps us to differentiate and learn easily. In this essay I am going to discuss two main legal systems Common and Civil Law Legal Systems and their criminal and civil procedures. Common Law Legal System Common Law Legal system is one of the most famous and widespreadly used system in the world.  [1]  En.wikipedia.org (2010) suggests that This system was originated from England in the Middle Ages and very common source of a lot of Western and Eastern countries such as United States of America (except Louisiana where English criminal law combined with French civil law), England, Ireland, Canada, Pakistan and Singapore which were colonized by British Empire. The main feature of the Common Law Legal System is that compare to other legal system the Judge is the main authority. . In this legal system the principles and rules of action based on decisions of courts made by judges and similar tribunals (similar cases) to decide future cases, rather than codified rules and legislations. Common law system these similar cases called as a precedent. The precedent which is might be applied to solve some problems is called as a binding precedent or mandatory precedent. Sometimes Judges in orde r to solve some cases uses not the exactly same precedents, but similar or precedents with some relevant information, such type of precedents called persuasive precedents. In some practical cases common law system is not ideal system to use, sometimes some controversial or more considerably complicated features may occur. Moreover, in Common law the decisions of the judge or court only compulsory within particular jurisdiction and some courts have more authority than others. The weight of court decisions also makes Common law different from Civil law system. By contrast, in civil law jurisdictions judge has more self-determination to interpret the given codification rather then predictability like common law system judges. Civil Law Legal System Civil (Continental) Law is a modern legal system originated by Roman law especially the system is derived from Code of Justinian, (during the Middle Ages the emperor Justinian played an important role on the development of the Civil Law System) as later developed by legal scholars later. This system is the most ancient and common legal system in the world. The main and unique feature of the Civil law is that it is collection of written and codified rules in the form of civil codes which are applied and interpreted by judges.  [2]   Criminal Procedures in Common and Civil Law Legal System Common Law and Civil Law Legal systems differ considerably in criminal procedure and civil procedures. Although some systems, including the Common legal system, let private individuals to bring a criminal prosecution against others, prosecutions are nearly always started by the state, in order to punish the defendant. However Civil law legal actions are started by private individuals, companies or organizations. The cases are usually in different courts, and juries are not commonly used in civil cases.  [3]   In both Common and Civil law systems the criminal procedures are significantly varies than in civil law systems. In criminal cases the government will be against the individuals the prosecutor will be on the sight of government and will protect the rights of the victims (society or government) and also in lower case actually the jury will be employed. In criminal procedures as a solution to the case Judge can decide the person who made crime to some sentence, such as fine, jail or time. In the next following sentences there is given how the criminal procedure will be taken in Common law legal systems according to the David Carnes: Prosecution Although a criminal defense lawyer is obligated to advocate the defendants interests, a prosecutor is obligated to seek justice even if it means refusing to charge or convict a defendant. Because of this, the decision of whether to prosecute rests solely with the prosecutor. Although most prosecutions are commenced in response to an arrest by the police of the filing of a criminal complaint by the police of a private citizen, a prosecutor has the authority to initiate prosecution unilaterally. Bail Bail is a sum of money that the defendant must pay to remain free between the bail hearing and the conclusion of the trial. The purpose of bail is to give the defendant a motive to show up at trial (in order to get the bail money back). Judges can set bail higher or lower depending on their estimate of how likely the defendant is to show up at trial. In many cases, bail is denied. Plea Bargaining A plea bargain is a written agreement in which the defendant agrees to plead guilty to a lesser charge, in exchange for which the prosecutor will recommend to the judge that the original charges be dropped and that a previously agreed upon sentence be imposed. The judge does not have to accept the prosecutors recommendations. Prosecutors are willing to plea bargain when they face busy trial dockets, and when the available evidence raises doubts about whether the defendant will be eventually convicted. Trial Practice Trials in common law countries are adversarial, meaning that the prosecution and the defense initiate almost all action while judges are relatively passive, acting as referees. For example, if the prosecution attempts to admit evidence that should be excluded under the rules of evidence, the evidence will normally be admitted anyway unless the defense objects to its admission. In this case, a convicted defendant may appeal on the basis that he received ineffective assistance of counsel. Although every criminal defendant is entitled to demand to be tried by a jury, if no demand for a jury trial is made then the judge will determine guilt or innocence. Sentencing Regardless of whether or not a jury is empanelled, the judge will determine the sentence (within statutorily defined ranges) if the defendant is convicted. The defendant is entitled to present evidence, such as good prior behavior or mitigating circumstances, that may convince the judge to imposed a lighter sentence.  [4]   Continental Legal Systems is the fundamental source of the Civil Procedure. It mainly refers to the civil law takes into account almost all the cases not related to criminal issues the laws almost all the cases which is not related to criminal issues such as business, estates, legal contracts, accidents and domestic issues and intended to protect individuals liberties and civil rights. Civil procedure refers only to the procedures, not the laws. In Civil procedure the role of lawyers are very important and it is specialized area of to practice them. However civil law and criminal law may overlap each other. In such cases the problem will be judged under both criminal and civil procedures. For instance, if the bus driver hits the people walking on the street and kills that person he can be tried in criminal court for killing the innocent people and the victims family members be able to give him to the court for the same case under the civil procedure. Conclusion In conclusion, I would like to state that law is very controversial and very complicated subject to learn. How deep you learn it you will discover more questions to answer. Sometimes you can discover such laws which can overlap each other.

Power of Art, Creativity, and Imagination in Children’s Literature Essa

Power of Art, Creativity, and Imagination in Children’s Literature â€Å"Imagination is the true magic carpet ride,† as Norman Vincent Peale once said. Indeed this proves to be true in Crockett Johnson’s, Harold and the Purple Crayon, when Harold, a small boy with a large imagination, creates his world using a purple crayon. Also, Leo Lionni uses a mouse named Fredrick to capture â€Å"colors† and â€Å"sunrays† in his Caldecott winning book Fredrick. However, imagination is not the only tool utilized in these books; art, and the power found in creativity are equally stressed. Also, while both books contain these three elements they address them in different ways. Both Harold and the Purple Crayon and Fredrick illustrate art as a medium for imagination and power; however, Fredrick emphasizes the effect of art on the community while Harold plays with his purple crayon seeing it a source for his own entertainment. Fredrick, a small field mouse, comes from the well spring of Leo Lionni’s mind to symbolize the impact art and imagination has on the community. Fredrick, unlike the rest of ...

How Michael Henchards Character In the Mayor of Casterbridge Led to hi

Why Michael Henchard’s Character Led to His Misery and Demise The Mayor of Casterbridge by Thomas Hardy is a novel about the rising and plummeting of a complex man named Michael Henchard. Michael Henchard does not just have one characteristic or just one personality for that matter. His personality can be described as thoughtful and strong-minded but also as ruthless, stubborn and cold. Henchard's impulsiveness, aggressive attitude, childishness and selfish nature made failure and misery inevitable in his life. The essence of his character is the root of his demise and misery. Michael Henchard’s pride and stubbornness leads to the start of his demise. When we first meet Henchard he is a dejected hay-trusser of twenty-one years, who is married to his wife Susan, with a young daughter, Elizabeth Jane. We see Henchard sell his wife and daughter in a drunken rage in a furmity tent at a county fair. It starts out first as a joke, but then is turned foul. "Why shouldn't they put 'em up and sell 'em by auction to men who are in need of such articles? Hey? Why, begad, I'd sell mine this minute if anybody would buy her!" Henchard said. The main reasons for Henchard continuing on with his joke to sell his wife and daughter to a sailor were his pride as well as the effect of the alcohol. Drinking alcohol leads to a couple decisions that Henchard comes to regret. In fact he often regrets things after he does them, and suffers the consequences. An example of this would be the fact that he sold his wife and daughter to a complete stranger for only five guineas. That sin stays nestled on his conscience and haunts him not only right after, but throughout his life. Henchard was young and naive and felt that his wife and daughter wer... ...titude. â€Å"Henchard’s Will: ‘That Elizabeth Jane Farfrae be not told of my death, or made to grieve on a account of me. And that I be not buried in consecrated ground. And that no sexton be asked to toll the bell. SL And that nobody’s wish to see my dead body.’† Michael Henchard’s constant exercise of jealousy, pride, immature actions and overwhelming emotions bring him to his tragic end. Although Henchard might have you think he is a victim, the reader can see that his personality leads to the conclusion of his downfall and that Henchard’s inability to learn from his first mistakes takes him down a path no one wants to face. He might have been able to survive his mistakes had he not been so self-destructive. But because of the combination of his personality traits and the complexity of his character’s mind, he is eventually led to the nothingness that engulfs him.

Love :: essays research papers

. Background Information   Ã‚  Ã‚  Ã‚  Ã‚  Timothy is the student that I have chosen to develop this portfolio on. Timothy is seven-year-old child in first grade at the elementary school that I do my fieldwork at. Timothy has not yet been selected for special education, as it is his first year in school. In the classroom Timothy struggles with most of what he is asked to do. He has very poor concentration, and has great difficulty in following directions. Timothy is very fidgety and extremely disorganized. The socioeconomic status of this student is much the same as the other students in the class. Most are children from middle to upper middle class families in the West Islip neighborhood. When I spoke with the classroom teacher Mrs. Dragelin, I obtained some information related to Timothy’s family. Both of his parents do live at home and there was mention of drug use during pregnancy. As far as Timothy’s attendance in school, so far this year the student has missed 1 day out of 36 days. Timo thy has not been retained in any grades, due to being in 1st grade. Timothy on average is usually prepared for school. He has forgotten books at home that were needed the next day for class, and left books in his book bag when they were needed at his desk. II. Types of Interventions Provided at this Time.   Ã‚  Ã‚  Ã‚  Ã‚  At this time Timothy is involved with a pullout program for remedial reading. Timothy attends the remedial reading program five days a week for thirty minutes. At this time Timothy is not assigned to the Resource room, speech, counseling, or any health related programs. The classroom teacher has suggested that an auditory trainer could be helpful to capture Tim’s attention. That device consists of a radio-microphone worn by the teacher and four speakers are setup in the classroom to broadcast the teachers voice. This device has not yet been implemented in the classroom by the school. III. Testing Data   Ã‚  Ã‚  Ã‚  Ã‚  At this time there is no official testing data on record for this student. Many of the evaluation testing is done in the first grade. This year’s test are scheduled for May 1st 2001. At that time standardized IQ test will be taken and specific areas in need of direct instruction will be identified. At this time with out testing I would suggest direct instruction in language arts. Timothy has no recognition of letter sounds; he displays little to no comprehension of sentences.

Influence of video games on youth Essay

What is not normally thought about when buying a new game console or game is: Do video games influence a child’s psychological development and make them more aggressive and violent? Do video games affect a child’s grades? These will be some of the topics we will be discussing. Some parents have the concern that video games, among other outlets, affect their children and cause them to be more aggressive and violent with other children their age and elders, also. Parents have the right to limit the time spent playing video games and partaking in the other outlets available such as media. According to Anderson and Gentile, [Parents have an important role to play. Psychologists have found that when parents limit the amount of time as well as the types of games their children play, children are less likely to show aggressive behaviors (Anderson et al. , under review; Gentile et al. , 2004). Other research suggests that active parental involvement in children’s media usage-including discussing the inappropriateness of violent solutions to real life conflicts, reducing time spent on violent media, and generating alternative nonviolent solutions to problems-all can reduce the impact of media violence on children and youth (Anderson et al. , 2003). ] On the contrary, as according to Anderson and Gentile, [Dr. Anderson and colleagues have shown that playing a lot of violent video games is related to having more aggressive thoughts, feelings, and behaviors (Anderson & Bushman, 2001). Furthermore, playing violent games is also related to children being less willing to be caring and helpful towards their peers. Importantly, research has shown that these effects happen just as much for non-aggressive children as they do for children who already have aggressive tendencies. ] Some studies have been done about the habits of children. Some of the studies showed that although children love to play video games alone, they prefer to play them more within groups. Parents, as well as teachers, have found that with some games, where reading, doing mathematical problems, and following instructions are needed, that their children’s grades have improved. The BBC (2002) stated, â€Å"Computer games could become part of the school curriculum after researchers found they had significant educational value. The UK study concluded that simulation and adventure games – such as Sim City and RollerCoaster Tycoon, where players create societies or build theme parks, developed children’s strategic thinking and planning skills. Parents and teachers also thought their children’s mathematics, reading and spelling improved. The investigation into the habits of 700 children aged seven to 16 also found that, far from being a solitary activity, children preferred to play games in pairs or small groups. † (para. 1-4) Video games can help develop the brain’s response time when the games used are dealing with with variables, teaching a specific skill or problem solving. Games have been used by several websites by politicians teaching politics and by the Nobel Prize Foundation to teach history. The Wikipedia () stated, â€Å"Video games can aid the development of proficiency by allowing users to interact with objects and manipulate variables. They are said to be particularly effective when designed to address a specific problem or teach a certain skill in curriculum subjects, where specific objectives can be stated and when deployed selectively within a context relevant to the learning activity and goal. Simple types of games can be designed to address specific learning outcomes such as recall of factual content. For instance, the Nobel Prize Foundation website uses on-line games to aid children in understanding the discoveries made by its laureates by embedding the scientific knowledge as part of the game environment. Video games have historically received more criticism than other forms of recreational learning because they are often perceived as or associated with issues such as mindless entertainment, enhanced social recluse, sexism and consumerism. However, a shift from pure entertainment to educational tool has emerged in recent times. Children growing up today can benefit from educational video games because they are already exposed to a society that is increasingly dependent on digital technology. The medium of educational games provides an opportunity for teachers to introduce educational and playful elements into the learning environment. With computer-aided learning programs, teachers may assist students on social aspects such as critical learning, knowledge based communication and effective interpersonal skills that traditional methods of teaching cannot offer. † (para. 2, 5-6). Many people are under the conclusion that by letting children play video games, they will spend less time outside. Even though children play video games, most children still partake in old fashion activities such as soccer, baseball, and many others. Most children still prefer to play in groups than to play alone. According to Cauchon (), [The fundamental nature of American childhood has changed in a single generation. The unstructured outdoor childhood – days of pick-up baseball games, treehouses and â€Å"be home for dinner† – has all but vanished. Today, childhood is spent mostly indoors, watching television, playing video games and working the Internet. When children do go outside, it tends to be for scheduled events – soccer camp or a fishing derby – held under the watch of adults. In a typical week, 27% of kids ages 9 to 13 play organized baseball, but only 6% play on their own, a survey by the Centers for Disease Control and Prevention found. ] On the contrary, according to Anderson and Gentile, [Drs. Anderson and Gentile’s research shows that children are spending increasing amounts of time playing video games – 13 hours per week for boys, on average, and 5 hours per week for girls (Anderson, Gentile, & Buckley, under review; Gentile, Lynch, Linder, & Walsh, 2004). ] In conclusion to all of the information above, we have concluded that video games are not the only effect on children that could cause them to be violent or aggressive in their childhood and when they are older. Children learn from the programs they see on TV, Music Videos, Video Games, and especially from what they see going on in their home. It is unfair for us to exclusively blame the video game creators and the stores that sell the products for the aggressiveness in children. Parents should also be held accountable, especially if they are the ones buying the games for their children. We both came to this agreement, thanks to the information we have gathered in reference to our topic of the influence of video games on the youth. It is irrelevant to believe that video games are a main factor or the most important factor of a negative development in children. References Pros: BBC. (2002). Video Games Stimulate Learning.
